Payment Plan Terms & Conditions + Refund Policy

These Terms & Conditions constitute a legally binding agreement between you (the Customer) and Geneva Brasswind Limited (“we”, “us”, “our”), governing the purchase of Geneva Instruments products, including payment plans, fulfilment, shipping, ownership, and refunds.

1. Definitions

  • “Instrument”: Any brass instrument or accessory manufactured or supplied by Geneva Brasswind Limited.
  • “Payment Plan”: An instalment-based payment arrangement agreed between the Customer and Geneva Brasswind Limited.
  • “Deposit”: A non-refundable initial payment required to reserve an instrument.
  • “Exceptional Circumstances”: Situations beyond the Customer’s reasonable control that may justify deviation from the standard refund policy.
  • “Custom Builds”: Instruments built specifically to customer-requested specifications.

2. Ordering & Contract Formation

By placing an order on our website, you confirm:

  • You are at least 18 years old or have legal capacity to contract.
  • You accept these Terms & Conditions.
  • You are entering a contract with Geneva Brasswind Limited.
    A contract is formed once we issue an order confirmation email.

3. Payment Plans

We offer multiple payment plan options to allow Customers to complete payment in instalments.

3.1 Deposit Requirement

A non-refundable deposit is required to reserve any instrument. This deposit:

  • Secures your allocation within our production or allocation queue.
  • Is non-transferable and non-refundable under all circumstances.

3.2 Instalment Payments

  • Customers will receive monthly payment links via email.
  • Instalment amounts and duration vary based on the plan selected at checkout.
  • Customers may pay the remaining balance in full at any time without penalty.
  • Custom-build orders cannot be extended beyond the original agreed payment schedule.

4. Refund Policy

Our refund policy is designed to provide clarity while recognising genuine hardship.

4.1 Non‑Refundable Payments

The following payments are strictly non-refundable:

  • The deposit.
  • The first monthly instalment.

4.2 Exceptional Circumstances Refunds

Refunds on subsequent instalments may be granted only in exceptional circumstances, assessed case-by-case.

Examples include:

  • Serious medical emergencies.
  • Major unexpected financial hardship.
  • Significant personal life events impacting your ability to continue payments.
Supporting Documentation

Geneva Brasswind Limited may request reasonable evidence before evaluating a refund request.

Processing

Approved refunds are issued within 7–10 business days.

4.3 Payment Plan Modifications

Customers (excluding custom-build orders) may request:

  • An extension to the existing payment schedule.
  • Minor adjustments to payment due dates.

Requests must be made in writing to info@genevainstruments.com after the deposit and first instalment have been paid.

5. Fulfilment & Shipping

  • Instruments are prepared, quality‑checked, and dispatched only after full payment has been received.
  • Lead time production schedule will be in line with your payment schedule.
  • Shipping costs, import duties, and taxes (where applicable) are the responsibility of the Customer unless otherwise stated.

6. Ownership & Risk

  • Ownership transfers to the Customer only upon full payment.
  • Until payment is complete, the instrument legally remains the property of Geneva Brasswind Limited.
  • Risk in the goods transfers to the Customer upon dispatch.

7. Customer Responsibilities

The Customer agrees to:

  • Provide accurate contact and shipping information.
  • Maintain valid payment details throughout the payment plan.
  • Notify Geneva Brasswind Limited promptly of any issues affecting payment.

8. Independent Dispute Resolution Policy

We aim to resolve all issues amicably.

8.1 Internal Resolution

Customers should first submit disputes in writing to: info@genevainstruments.com

We will:

  • Acknowledge receipt within 5 business days.
  • Aim to propose a resolution within 14 business days.

8.2 Independent Review

If internal resolution is unsuccessful, either party may request a neutral third-party mediator.

  • Mediation fees will be shared equally unless otherwise required by law.
  • Mediation is non-binding.

Customers retain all rights to pursue legal remedies following mediation.

9. Force Majeure

Geneva Brasswind Limited is not liable for delays or inability to fulfil obligations caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Supply chain disruptions
  • Illness or injury
  • Strikes or transportation delays
  • Acts of government or emergency situations

10. Limitation of Liability

To the maximum extent permitted by law:

  • Geneva Brasswind Limited’s liability shall not exceed the purchase price paid.
  • We are not liable for indirect or consequential losses, including loss of earnings or performance opportunities.

11. Governing Law

These Terms & Conditions are governed by the laws of the United Kingdom.

Any disputes shall be subject to the exclusive jurisdiction of UK courts, following optional mediation.

12. Agreement Acceptance

By placing an order and/or selecting a payment plan, the Customer confirms acceptance of these Terms & Conditions, forming a binding agreement with Geneva Brasswind Limited.
